Waiver and Release of Liability
In consideration of my use of the exercise equipment and facilities provided by A Little More Support and hosting facility, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that A Little More Support and hosting facility and their insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, or my guest in, on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of A Little More Support and hosting facility.
By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge A Little More Support and hosting facility, their insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facilities.
I expressly agree to indemnify and hold A Little More Support and hosting facility harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me or my guest.
I agree to be solely responsible for safety and well being of my guest and myself. I understand that A Little More Support and hosting facility do not provide supervision, instruction, or assistance for the use of the facilities and equipment.
I agree to comply with all rules imposed by A Little More Support and hosting facility regarding the use of the facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.
I understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death.
I understand and agree that A Little More Support and hosting facility are not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.
In the case if the participant is a minor:-
Parent and/or legal guardian of minor participant in any class, activity or event should consult with his or her physician or have a physical examination before using any of the facilities or enrolling in any of the classes or events, especially if the participant has a history of chronic illness or has physical limitations.
Parent and/or legal guardian of minor participant and his or her guests assume the risk of any and all accidents or injuries of any kind that may be sustained by, or in connection with, use of Gym facilities. A Little More Support and hosting facility cannot guarantee that any facility or equipment is free of risk. Participant agrees to use care in the use of facilities, equipment and services and to protect against accidents by other participants.
Parent and/or legal guardian of minor participant has been informed and acknowledges that A Little More Support and hosting facility make no claims as to medical results that can or may be obtained through use of the facilities, equipment or services. A Little More Support and hosting facility have neither suggested nor will suggest any medical treatment to participant. Only licensed medical professionals are qualified to give medical advice. Participant is instructed not to act on the advice given by any unlicensed employee unless such advice has been verified by participant’s licensed physician.
Parent and/or legal guardian of minor participant represents that:
(a) there are no medical or physical conditions that would preclude his or her use of the facilities;
(b) he or she has not been instructed by any physician not to use Club; and
(c) he or she is in good health and has no disability, impairment, injury, disease or ailment
preventing him or her from engaging in active or passive exercise or which could cause increased risk of injury or adverse health consequences as a result of exercise.
By signing this Agreement and/or by attending classes or otherwise participating in Club activities, Parent and/or legal guardian of minor participant hereby acknowledges and agrees that there are inherent risks in the exercise and activities that the Club offers, and in using the equipment associated with the Club’s classes or instruction. Participant assumes full responsibility for his or her use of the Club’s facilities and shall indemnify A Little More Support and hosting facility and their Board of Directors, shareholders, affiliates, agents, consultants and employees, against any and all liability arising out of the use of the facilities. Additionally, Parent and/or legal guardian of minor participant and his or her guests shall hold A Little More Support and hosting facility harmless from any loss, theft, cost, claim, injury, damage or liability incurred as a result of Club use and activities.
Parent and/or legal guardian of minor participant understands that by signing below, he or she agrees to indemnify A Little More Support and hosting facility and their shareholders, affiliates, agents and employees, against any and all liability to him or herself and child arising out of any use of the facility.
